May is NYC Bike Month. With the great weather earlier this month, it seemed like pedicabs, a tricycle with a 2-seated wagon, are coming out of the woodwork. As I cross the street from my office to Grand Central Station I see happy, relaxed passengers sitting in the back of pedicabs conversing with their driver. This is the first summer that the new rules concerning pedicabs are in effect. Taxi drivers and pedestrians have expressed pleasure with the results of the new rules that went into effect on November 30, 2009. But the industry itself may not be as pleased although its unhappiness may in partrelated to the economy. The rules require that all pedicabs be inspected, insured, registered, and equipped with seatbelts and tail lights and that all pedicab drivers be licensed by the Department of Consumer Affairs. T

Pedicabs, the three-wheel pedaled vehicles with a carriage in the back have gone unregulated for years in New York City. They are increasingly popular among tourists and New Yorkers in fact, our office has recently been contacted via the internet from Australia on behalf of a visitor who sustained injuries, including a broken collar bone, while a passenger in a pedicab that was struck by a motor vehicle. Up to the bills signing on August 12, 2009, its been a bit of a free-for-all. Thats changed now. Under Local Law 53 of 2009, which amends Local Law 19 of 2007, pedicab businesses have 60 days to submit complete applications to DCA to obtain a Pedicab Business license and register their pedicabs. Anyone walking the streets of Manhattan is aware of the prevalence of pedicabs, pedal-powered tourist-friendly tricycles. Pedicab owners estimate that there were about 1,000 pedicabs in the city. But what if someone suffers personal injuries while a passenger in one or is involved in an accident with one? Who will pay for the injuries and damage caused? New York State has financial responsibility requirements for motor vehicles and motorcycles. Not so for pedicabs. In an effort to change that, the city will move forward with its long-stalled regulation of pedicabs by establishing a licensing procedure.
