MR. IRA SLAVIT: One of the recent cases we handled involving a motor vehicle accident was a very substantial case where we represented a woman who was driving a car on a parkway on a windless morning and a tree next to the parkway fell down and landed on top of her windshield as she was driving.

We brought a lawsuit against the governmental agency that was responsible for maintaining the highway and one of the first things we did was we hired an arborist as an expert to go take a look at the tree to see the condition of the tree so that we would be able to prove that there was negligence in failing to notice that the tree had been dead for quite a number of years and that it should have been removed because the highways was a target area for the tree and that it posed a danger to people driving cars and would cause an accident.

In that case, our client sustained injuries to her back. She had to have multiple surgeries to her back and a surgery to her knee. In the end she was very satisfied with the result that Levine & Slavit obtained for her.
