MR. IRA SLAVIT: At our office we handled the case of a bus accident in New York City, in Manhattan near Times Square, where a person who was not working, it was a retired actor, was crossing the street and he was run over by a bus.
Levine & Slavit retained a forensic pathologist to review the hospital records and ambulance records and the medical examiner's autopsy report and we were able to establish that the pedestrian had a fear of impending death as he saw the bus coming towards him just before the accident happened.
We also had presented a claim for punitive damages which can be very difficult to obtain in New York. We were, however, with extensive legal research, able to defeat the motion to dismiss the punitive damage claim, which enabled us to enter into fruitful settlement negotiations and resolve the case for the family who was run over by the bus.
