MR. IRA SLAVIT: As with almost any case, it's important not to leave any stones unturned. Sometimes in a construction accident or an accident involving a building, it may not be so obvious what the owner did wrong. It may amount to a simple fact that the owner just didn't bother to get the proper expert, such as an architect or an engineer to draw plans.
Examples of this are where somebody is building something new and they're digging out a trench for a foundation and they don't shore up the walls. The walls collapse and a worker gets buried alive.
Also, you see so many of these sidewalk sheds, which people commonly refer to as scaffolds in the city, where up until now you don't even have to have an engineer to draw up plans to be sure that it's properly supported. That's going to change with the new law in New York City. If you would like further information on this or anything related, please contact Levine & Slavit and speak to one of our attorneys.
