MR. IRA SLAVIT: In some cases where the death is caused by a police officer or someone else acting on behalf of the government, it may be possible to bring a civil rights action in addition to the traditional wrongful death action.
The United States Constitution and the federal civil rights laws provide remedies for the deprivation of life and liberty and it has been held by several courts that in determining that definition of liberty that can include someone's loss of a minor child.
The death of someone else becomes the parents' loss of liberty and that provides a basis to bring a civil rights action where the amount that can be recovered can be very meaningful and significant.
