MR. IRA SLAVIT: New York law provides special protection for workers on the outside of high rise buildings washing windows or cleaning the exterior of the buildings. It's Section 202 of the Labor Law.
What it does very importantly is it makes owners of buildings and some others responsible for violations of worker safety regulations, even if the owner himself doesn’t or isn't the one who didn't follow the regulations. It's what's called a non-delegable duty. And the worker may have a valid lawsuit against the owner, even if the owner is not directly involved.
