MR. IRA SLAVIT: At Levine & Slavit we've been representing workers injured in construction accidents for many years. There are different types of things that can happen to workers on the job anywhere.

In New York State the law is particularly concerned with protecting the rights of workers. The cases that we are involved with in construction accidents are not the workers compensation cases. Workers compensation cases involve claims made by the worker against the company that they work for. They are not allowed in New York State to bring a lawsuit.

However, in New York state, an injured construction worker is able to bring a lawsuit for personal injuries sustained in an accident if the accident is caused by the negligence of someone other than their employer, or if the law imposes a duty on an owner or a general contractor for workers injured in accidents.

So someone injured in an accident on a construction job in addition to the workers compensation, may have addition rights to recover damages for their injuries in a lawsuit against entities other and companies other than their employer.
