Each year, fall festivals are held where patrons are able to enjoy food, music, and rides such as the Ferris wheel. While many believe these fall festivals are family-friendly and safe events, there have been a growing number of incidents resulting in death or serious injuries. In 2016, a study conducted by the U.S. Consumer Product Safety Commission (USPC), found that 31,000 people were injured on rides at festivals and fairs. Many of these injuries occurred due to ride malfunctions.
Recently, a young girl fell 25 feet out of a gondola ride in Six Flags. In July 2017, a child died at a fair after a ride malfunctioned. In 2016, 14 people were injured on a Moonraker ride after the computer system shutdown the ride because it detected a problem. In that case, the operator improperly released the safety restraint resulting in eight people dangling mid-air. The victims were taken to a local hospital for treatment.
With patrons often consuming alcohol, another concern is the potential for fights at these fall festival events. A festival must provide adequate security as well as take the proper steps to mitigate risk and ensure peace. In addition, safety measures must be taken to maintain the grounds. This means that staff members must be aware of any spills or slippery surfaces so that patrons are not injured in a slip and fall.
In the event that an individual is injured at a fall festival or fair, there are certain legal theories that may be used to recover compensation for medical expenses, lost wages, or pain and suffering. These theories include, but are not limited to:
- Manufacturers negligence
- Operators negligence
- Negligent maintenance
- Failure to adequately inspect
- Negligent security personnel
- Negligent training and or hiring
