On August 21, 2017, Johnson & Johnson was the defendant in the largest talcum powder verdict of $417 million. A California jury awarded $70 million in compensatory damages and $347 million in punitive damages. The plaintiff alleged that the talc-based product, Baby Powder, caused her ovarian cancer. She argued that Johnson & Johnson encouraged women to use the product for hygiene even though studies linked talc with ovarian cancer.
Recently, there have been a number of suits filed against Johnson & Johnson. The suits claim Johnson & Johnson concealed the dangers of the use of talc-based products. Prior to the most recent verdict, Johnson & Johnson lost all lawsuits except for one. Collectively, juries in these cases awarded over $300 million. Like the other cases, a representative for Johnson & Johnson said the company would appeal the California verdict.
The juries in each of these cases have awarded punitive damages. Punitive damages are meant to punish the defendant by awarding excess compensation. It is also meant to deter other within an industry from engaging in the same behavior. Punitive damages are applicable when a defendant knowingly or intentionally causes harm. In the instant case, it was argued that Johnson & Johnson caused harm to consumers by failing to remove the product from the market, because the company was aware of the link between talc and ovarian cancer. In the claims against the company, damages for the Plaintiff’s included those for medical expenses, lost wages, pain and suffering, punitive damages and even wrongful death.
