Hyundai Sued Over Defective Anti-Lock Brake System (ABS) By Levine & Slavit PLLC on November 14, 2023

A class action lawsuit has been filed against Hyundai Motor Co. and Hyundai Motor America for alleged breach of warranty and consumer fraud after an alleged defect was found with their anti-lock brake system (ABS). This defect could allegedly cause the ABS mechanism to short out, causing mechanical failures in the system and potentially resulting in vehicle fires. Hyundai recently issued a recall to repair the part, but the lawsuit alleges the recall does not go far enough to address potential safety issues.


What is Hyundai?


Hyundai Motor Co. is a South Korea-based car manufacturer with subsidiaries all across the world, including in the United States. It sells a variety of models of cars, including the Elantra, the Sonata, the Genesis, and the Santa Fe, among others. It made about 117.6 trillion South Korean won, or about $90 billion US, in 2021, and employs around 100,000 people.


What is an Anti-Lock Brake System?


An anti-lock brake system, or ABS, is a type of system that helps your vehicle maintain traction when you suddenly apply the brakes to come to a quick stop. The system monitors the speed of your wheels, and makes automatic adjustments to prevent your wheels from locking up in the event that you suddenly hit your brakes very hard. This allows you to maintain greater control of your vehicle in an emergency, making it easier to maneuver and avoid or mitigate harm from an accident.


What Was Wrong With The ABS in These Cars?


The ABS in the affected Hyundai vehicles (which include models with manufacturing years between 2010 and 2015) allegedly suffered from an electrical fault that could cause them to short out. This could cause the brakes to suddenly apply without warning, cut power to the brakes while in use, or even start an electrical fire inside the vehicle. Approximately 3.3 million vehicles are supposedly affected by this defective ABS.
