MR. LEONARD SLAVIT: We recently settled a case of a woman who was attending a class at a school. She was in her 30s and 40s, but she was taking a course. It was the initial part of the session, so to speak. Walking down the front steps of that school building, she tripped and fell.
What made the case interesting was that we hired promptly an expert who came to the scene, took measurements, examined the conditions, and took photographs. He determined that the steps were uneven, which is a violation of a code. He also determined there was a handrail that was missing, which was also a factor where she could not hold onto something to break her fall.
The testimony that was going to be given at the time of trail, and this case was settled at the beginning of the trial, that testimony was vital in getting the result we were able to obtain for her because of what the expert determined and found.
It's so helpful to have somebody do an investigation at the beginning of a case, early on, and have that information so that the defendant knows we are well prepared and we will try the case if it's not resolved at a fair figure.
