MR. IRA SLAVIT: It's important that the attorney that you hire is experienced and is able to pay attention to details and think creatively about what sources or who may be responsible for an accident beyond the obvious. When someone is injured it's obvious that another motor vehicle, the owner and the driver may be responsible.
We had a case recently where we represented a passenger on a motorcycle. The motorcycle was struck by another vehicle. That vehicle had minimal insurance coverage. In looking into the case and the photographs of the scene that were available, we noticed construction materials on the roadway, which may have contributed to the happening of the accident.
We brought a lawsuit against the other vehicle and against the public utility involved and were able to obtain a satisfactory settlement for our client, not just from the insurance company for the vehicle, but also from the public utility.
