Pedicab and Bicycle Accident Laws and Liability

A pedicab is a bicycle with a carriage attached to its back where passengers can sit. It is a means of for-hire transportation used frequently throughout NYC. The carriage is unprotected, with nothing behind it to cushion the impact of a collision from the rear. Because of a number of accidents where passengers in pedicabs were seriously injured, New York City enacted regulations that became effective on November 30, 2009. These regulations require that all pedicabs be registered, inspected and insured, and pedicab drivers must obtain a pedicab driver license. Each pedicab must have certain safety features such as providing seat belts and must have posted a sign setting forth information including the name of the licensee, the registration number, and how to contact the NYC Department of Consumer Affairs if there is a complaint.

Pedicab businesses must have insurance policies providing liability coverage for injury or death of any person or persons, and damage to or destruction of any property in either a combined single limit amount of $2 million with a maximum of $1 million for each accident OR they must insure each cab for such liability in the amount of $100,000 for personal injury or death to one person, $300,000 for personal injury or death to all persons in one accident with a maximum of $100,000 for each person, and $50,000 for property damage. All insurance policies must name the City of New York as an insured party.

Medical and hospital bills of injured bicyclists and pedicab passengers are covered by New York State’s “Comprehensive Motor Vehicle Insurance Reparations Act,” commonly known as the “No-Fault Law.” The no-fault insurance coverage also pays for loss of earnings through the insurance policy of a motor vehicle involved in an accident.
